The State of Alabama
Coosa County

I John Fleming of the said County and State being of sound mind and disposing memory do make and publish this my last will & Testament.

And first I desire that my body be decently buried and that my funeral expenses and the expenses of my last sickness be paid out of the rent of my land in the County of Covingtona in said state and recently purchased by me and now rented to James B. Russel of said county or from the sale of my cattle that my friend James B. Russell ha(s) promised to take care of in said county of Covington.

2nd I give and bequeath all my land to be Equally divided share & share alike lying in the County of Covington in said State and described as the SW 1/4 NW 1/4 of Section 29 Township 7 Rang 17 containing forty acres unto my sons John Quincy James Fulton Robert H Jackson Lafayette and William J and my Daughter Sarah Jane and if any one or more of them should die without issue then my desire is that the survivor or survivors should take said Land as fully and entirely as though thare ware no other heirs of my estate.

3rd I give and bequeath unto mhy daughter Ann Saphlow the infant child of my present wife the three notes I hold on John A Seltzer of Coosa County amounting in all to one Hundred & thirty seven 50/100 Dollars and due 25th December next & for the purpose of aiding my said wife in raising and Educating my said daughter Ann Saphlow I also direct that the whole of my household furniture shall be and remain the absolute property of my beloved wife Rachael Fleming together with all of my worldly goods of whatever name or character all choses in action of right title and Interest that I may have in of any Act of Congress passed the 28th day of September A D 1851 and other of my personal Estate not hereinbefore bequeathed and I hereby make and ordain my esteemed friend and neighbor N Smith Graham Executor of this my last will and testament.  In witness whereof I John Fleming the testator have to this my will set my hand and seal this the 29th day of March A D 1851.
